Legal and Regulatory Issues Presented by Health Care Reform

Summary: According to the author, health care reform will require rethinking the relationship between the federal and state governments with respect to health care, in addition to redefining legal entitlements to health care. Finally, revisions of laws regulating health insurance and health care markets will be necessary. This paper examines four areas where changes in the law will be necessary to implement health care reform: The relationship between federal and state authority and responsibility in governing health care; The definition of health care entitlements; Regulation of markets for health insurance and regulation of the delivery of health care products and services.
